Profile

David’s practice is focused principally on construction litigation. In his practice, he represents general contractors, subcontractors, developers, and architects in various disputes including payment and contractual disputes, deficiency and delay claims, and builders lien disputes.

Where appropriate, David takes a practical and resolution-focused approach to disputes aiming to resolve issues before significant expense is incurred. Where required, David will fiercely litigate a dispute in order to achieve the best outcome for his clients.

David has represented clients at all levels of court in British Columbia, including in the Court of Appeal, and has experience representing clients in mediations, arbitrations, and other forms of alternative dispute resolution.

Experience Highlights

  • Acting as counsel for a large window installation subcontractor on a complex construction delay matter, successfully obtained $150,000.00 in security for costs against the window supply subcontractor (1600 Davie Limited Partnership v. Metal Yapi Holding A.S., 2025 BCSC 979).
  • Successfully defended an owner accused of conducting unpermitted construction in violation of a municipal bylaw in a bylaw proceeding in Court resulting in a dismissal of charges alleging unpermitted construction (The Corporation of the District of Saanich v. Caddell, 2026 BCPC 92).
  • Achieved an order cancelling a certificate of pending litigation filed against a property prior to completion of a sale and subsequently achieved the release of $868,000.00 held in trust in substitution for the certificate of pending litigation (Ng. v. Cheung [unreported]).
  • Counsel for various general contractors and subcontractors in relation to payment disputes and builders lien claims.
