Profile

Spencer maintains a general litigation practice with a focus on construction disputes. Spencer is a well-rounded litigator with experience representing clients in a wide variety of disputes. This broad experience means Spencer can adapt and respond to specific scenarios, whether in ongoing construction projects, in Court, or in alternative dispute resolution.

Practicing construction law, Spencer provides strategic advice to clients during construction projects and disputes, including filing, enforcing, securing, and removing liens as well as litigating disputes including delay, defect, and payment denials through every stage of litigation including mediation, arbitration, and trial. Spencer also has experience in litigation related to 2-5-10 new home warranties. In addition to construction law, Spencer’s practice includes:

  • Helping clients challenge denials of insurance coverage by insurance companies;
  • Administrative law, including acting as prosecution counsel for professional regulatory bodies;
  • Product liability, including fire/flood damage relating to machine failures, including HVAC systems;
  • Disputes related to real property, including commercial leasing; and
  • Corporate/commercial disputes, including shareholder remedies.

Spencer was called to the Ontario bar in 2020 and the BC bar in 2022. Prior to joining JML, he articled and practiced at one of Toronto’s original civil litigation boutiques. In early 2022, Spencer and his family moved to BC, where he first practiced with a national law firm before finding a home at JML. He has argued before the BC Supreme Court, Ontario Superior Court, and Court of Appeal for Ontario, as well as administrative tribunals. He has conducted a variety of mediations and boasts a healthy settlement record.

Before practicing law, Spencer worked in the financial services industry. Spencer learned that providing financial advice requires tailoring solutions to each client’s specific needs. The same is true in law: everyone deserves advice and representation tailored to their unique circumstances.
